1. Acceptance of Terms
By downloading, installing, and using the Dreamtale mobile application (the "App"), you agree to be bound by these Terms of Service (the "Terms"). If you do not agree to these Terms, please do not use the App.
AGM Digital ("Company," "we," "us," or "our") operates the Dreamtale App. These Terms constitute a legally binding agreement between you and AGM Digital. Your use of the App indicates your acceptance of all terms and conditions contained herein.
2. License Grant
We grant you a limited, non-exclusive, non-transferable license to download and use the App on your personal iOS devices for your personal, non-commercial use, subject to these Terms and the App Store's standard terms of service.
This license does not permit you to:
- Copy, modify, or create derivative works of the App
- Reverse engineer, decompile, or disassemble the App
- Sell, rent, lease, or lend the App
- Use the App for any commercial purpose
- Remove or alter any copyright, trademark, or other proprietary notices
3. User Accounts and Subscriptions
3.1 Account Creation
The App may not require account creation. If account features are available, you are responsible for maintaining the confidentiality of any login credentials and for all activities that occur under your account.
3.2 Premium Subscription
The Dreamtale App offers an optional auto-renewable Premium subscription that provides enhanced features including:
- 10 story generations per day (vs. 1 per day for free users)
- Access to premium exclusive content
- Offline download capability for generated stories
3.3 Subscription Terms
Your Premium subscription is managed through Apple's App Store and governed by Apple's subscription terms. By subscribing, you authorize Apple to charge your App Store payment method on a recurring basis according to your selected billing cycle.
Important:
- Subscriptions are auto-renewable. Your subscription will automatically renew at the end of each billing period unless you cancel
- You can cancel your subscription anytime through your iOS device settings (Settings > [Your Name] > Subscriptions > Dreamtale > Cancel Subscription)
- Cancellation takes effect at the end of your current billing period
- No refunds are provided for unused portions of your subscription
- Pricing for subscriptions is subject to change with 30 days' notice
3.4 Restoring Purchases
If you reinstall the App or use a new device, you can restore your subscription through the "Restore Purchases" feature by signing in with your Apple ID.
4. User-Generated Content
4.1 Your Ownership
You retain all rights to the fairy tales and stories you generate using the App ("Your Stories"). You own the original content created through the App's generation features.
4.2 Grant of License to Company
By creating and storing stories in the App, you grant AGM Digital a worldwide, non-exclusive, royalty-free license to use, store, and improve Your Stories for the purposes of operating and enhancing the App, including:
- Storing Your Stories on our servers
- Displaying Your Stories within the App
- Using anonymized data to improve the App's story generation capabilities
4.3 Sharing and Distribution
You may share Your Stories with others through the built-in share features or by other means. When you share a story, you grant the recipient a non-exclusive license to view and read the story.
4.4 Prohibited Content
You agree not to create or generate content that:
- Is illegal, threatening, abusive, defamatory, obscene, or otherwise objectionable
- Violates any third-party rights or intellectual property
- Contains malware, viruses, or other harmful code
- Infringes upon copyrights, trademarks, or other proprietary rights
We reserve the right to remove content that violates these terms.
5. Intellectual Property Rights
5.1 App Ownership
The Dreamtale App, including all code, graphics, logos, designs, and other content (excluding Your Stories), is the exclusive property of AGM Digital and is protected by copyright, trademark, and other intellectual property laws.
5.2 Limited Rights
You may not reproduce, distribute, or transmit any App content without our prior written consent, except as necessary for your personal, non-commercial use as permitted by these Terms.
5.3 Trademarks
"Dreamtale" and related logos and trademarks are the property of AGM Digital. You may not use these marks without our permission.
6. Limitation of Liability
DISCLAIMER: THE APP IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. AGMDITAL MAKES NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE APP'S FUNCTIONALITY, ACCURACY, OR FITNESS FOR A PARTICULAR PURPOSE.
To the maximum extent permitted by law, AGM Digital shall not be liable for any:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of data, revenue, or profits
- Business interruption or loss of business opportunity
- Damages arising from your use of or inability to use the App
This limitation applies regardless of the cause of action or legal theory, whether in contract, tort, or otherwise.
7. Indemnification
You agree to indemnify, defend, and hold harmless AGM Digital, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including attorneys' fees) arising from:
- Your use of the App
- Your violation of these Terms
- Your infringement of any third-party rights
- Your conduct or actions related to the App
8. Third-Party Links and Services
The App may contain links to third-party websites or services. We are not responsible for the content, accuracy, or practices of third-party services. Your use of third-party services is governed by their terms of service and privacy policies, not these Terms.
9. Termination
9.1 Termination by You
You may discontinue your use of the App at any time by uninstalling it from your device. Your subscription will continue until cancelled through your App Store account.
9.2 Termination by AGM Digital
We reserve the right to terminate your access to the App if you violate these Terms or engage in conduct that harms the App or other users. Upon termination, your license to use the App is revoked, though you retain ownership of Your Stories.
9.3 Effect of Termination
Upon termination, your right to use the App ceases immediately. Provisions of these Terms that are intended to survive termination (such as intellectual property rights and limitation of liability) shall remain in effect.
10. Modifications to Terms and Services
We may modify these Terms or the App at any time. Material changes will be communicated to you via in-app notification or email. Your continued use of the App following any modifications constitutes your acceptance of the updated Terms.
We may also modify, suspend, or discontinue the App or any features at our sole discretion. If the App or core features are discontinued, we will provide reasonable notice.
11. Pricing and Changes
Subscription pricing is subject to change. We will provide at least 30 days' notice of any price increases. If you do not accept the new pricing, you can cancel your subscription before the change takes effect. Continued use of a paid subscription after a price change indicates your acceptance of the new price.
Free features and quotas may also change at our discretion.
12. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of Germany, without regard to its conflicts of law principles. You agree to submit to the exclusive jurisdiction of the courts located in Germany for any legal proceedings arising from these Terms or your use of the App.
13. Dispute Resolution
Before initiating legal proceedings, we encourage you to contact us to resolve any disputes. Please email dev@agm-digital.de with a detailed description of your concern.
If we cannot resolve your dispute within 30 days, either party may pursue legal remedies as permitted by applicable law.
14. Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid, or if not possible, severed, and the remaining provisions shall remain in full force and effect.
15. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and AGM Digital regarding the App and supersede all prior agreements and understandings. No other communication or representation is binding unless made in writing and signed by an authorized representative of AGM Digital.

17. Children's Use
